Generally there are two types of Divorce one is Mutual Divorce and another is Contested Divorce. First we will look at the process of Contested Divorce. A quick step by step process to file for Divorce in india is given below.

  1. Petition filing : First you have to file a petition in the District court where you will mention the ground for divorce , the details of your spouse his or her address. This can be done either by one spouse (for one-sided divorce) or jointly by both spouses (for mutual divorce).
  2. Court Appearance: After that you have to appear in the court for the first hearing and verifying yourself.
  3. Summoning : On the basis of your petition court will summon the other party and then other party will give his or her reply to your petition after which both party will present their evidences whatever they have. After which court pronounce the judgement.

The above process is very shortly explained it takes minimum more than a year in case of contested Divorce. As one has to present his evidences and their are various other stages involved in court like cross examination etc.

Petitioner needs not to be present on every date however it is advised to present on each hearing as it will result in fast disposal of the case. One must have a lawyer to represent his or her case in the court. In the absence of Lawyer it becomes very difficult to obtain a favorable result.
